Appeal by the plaintiff, William W. Farley, as State Commissioner of Excise, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of Hew York on the 11th day of February, 1914, upon a dismissal of the complaint by direction of the court at the close of plaintiff’s case, and also from the order entered in. said clerk’s office on the 9th day of February, 1914, dismissing the said complaint.

McLaughlin, J.:
Action to recover upon a liquor tax bond given by the respondent Bronx Bath and Hotel Company as principal. The complaint alleged the giving of the bond, the issuance of the liquor tax certificate and a violation of the bond by the selling of liquors on certain Sundays named without serving meals therewith. The answer put in issue the material allegations of the complaint, but at the trial the issuance of the bond and certificate was admitted.
