Appeal by the defendant, Vincenzo D’Antonio, from a judgment of the Court .of Special Sessions of the city of New York, rendered on the 4th day of November, 1910, convicting the defendant of a violation of the Liquor Tax Law.

McLaughlin, J.:

The defendant appeals from a judgment of the Court of Special Sessions of the city of New York convicting him of a misdemeanor, for which he was sentenced to pay a fine of ten dollars, or in default thereof be imprisoned two days in the city prison. The crime charged, and for which he was convicted, consisted in violating subdivision H of section 30 of the Liquor Tax Law (Consol. Laws, chap. 34 [Laws of 1909, chap. 39], as amd. by Laws of 1910, chap. 494).
