The county of Lewis entered into a contract with one Graves by the terms of which the latter agreed to furnish all of the necessary labor and material, and construct a bridge for the county. The contract was in the usual form in such cases, and, among other things, provided that the contractor should furnish a bond conditioned, as. the statute requires, to pay for all labor, material and supplies furnished the contractor in the prosecution of the work.
