This is a companion suit to that of J. E. Spencer et al. v. Temple Trust Company (Tex. Civ. App.) 36 S.W.(2d) 602, this day decided. It is the same character of suit. The appel-lees, Temple Trust Company et al., brought this suit in the district court of Eastland county against various defendants: J. E. Spencer, alleged to reside in Eastland county, Tex.; W. E.
