Introduction

The instant action arises out of an automobile accident in which Alexzandra 1 Loos (“Alexzandra”) was killed. Pending before the court are the parties’ cross-motions for summary judgment concerning whether plaintiff Employers Mutual Casualty Company (“plaintiff’) breached a contractual duty allegedly owed to Alexzandra’s parents by denying their claim for underinsured motorist (“UIM”) benefits.
