Presently pending in this action alleging breach of contract and related tortious activity is the Defendants’ Motion To Dismiss Pursuant To Rule 12(b) Of The Federal Rules Of Civil Procedure, Or, Alternatively, To Transfer This Case To The Southern District Of West Virginia (D.I.ll). 1 By their Motion, the Defendants urge the Court to dismiss this action because: (1) the Court lacks personal jurisdiction over the Defendants; (2) venue is improper in this District; and (3) the Plaintiff failed to properly serve the Defendants with process.
