This matter is currently before the Court for consideration of the motion of the United States Environmental Protection Agency (hereinafter referred to as “USEPA”) to va= cate this Court’s August 4, 1993 Order temporarily restraining USEPA from acting in any manner with regard to the flooding at Plaintiffs Meigs Mine Number 31 (hereinafter referred to as “Meigs 31”) in Meigs County, Ohio.
