The sheriff of Spokane county, having in his hands money amounting to $1,149.90, to which he makes no claim, being a mere stakeholder thereof, and being advised that the defendants, railway company and others, might have claims of interest therein, commenced this action in the superior court for Spokane county to have their interests therein determined and himself relieved from responsibility with reference thereto, at the same time depositing the money with the clerk of the superior court to abide such determination.
