Judgment, Supreme Court, New York County (Rose Rubin, J.), rendered June 24, 1986 which convicted defendant, after a jury trial, of grand larceny in the third degree and sentenced her to a 2- to 4-year prison term, unanimously reversed, on the law, and the case remanded for a new trial.

Appellant was arrested in Macy’s department store after she allegedly stole a wallet from the handbag of a customer waiting on line at the cosmetics counter.
