Plaintiff in error sued the testator of defendant for a breach of contract, upon a warranty made by him to plain.tiff of certain German millet seed which plaintiff bought for the purpose of planting and raising a crop therefrom, which purpose was well known to defendant. He (defendant) at the time of said purchase warranted said- seed to be good, and that the same would germinate and grow. Plaintiff alleges that he went to great expense, labor and care to prepare and fertilize his lands, and that with great care he planted the seed ; but the same wholly. failed to *781germinate or…
