O’NEAL, Justice.
In this case it appears that on and prior to the 14th day of January, 1948, C. R. Virtue and Harry" Culver, doing business as Gas and Oil Industries, hereinafter referred to as defendants, were the owners of an oil and gas lease covering 160 acres *440of land located in Hughes County, Oklahoma; that defendants employed J. B. Smith, doing business as J. B. Smith Card-well Service, hereinafter referred to as plaintiff, to do the work necessary to complete an oil well which had been commenced on the premises; that plaintiff started working on the well on the 15th day of January, 1948.
