“This is a suit for damages for personal injury and damages to an automobile, arising out of a collision occurring between an automobile, owned by the appellee,, which was being driven by him in a southerly direction on Olive Street, and a passenger train of the Southern Railway Company going east toward the intersection in the Western part of the City of Louisville, Kentucky,, on September 26, 1942 at about 8:05 P.
