This is a personal injury case arising from a traffic accident. Appellees Jose Castro-Lopez and his daughter Lorena Castro (the Castros) were two of the plaintiffs and appellant Ten Hagen Excavating, Inc. was one of two defendants. After a week-long jury trial in which liability and damages were contested, both issues were resolved against Ten Hagen.
