The defendant was tried before a jury of six on a complaint that he had operated a motor vehicle on a public way while under the influence of intoxicating liquor, in violation of G. L. c. 90, § 24 (1984 ed). That statute provides in pertinent part that “[wjhoever, upon any way or in any place to which the public has a right of access, or upon any way or in any place to which members of the public have access as invitees or licensees, operates a motor vehicle while under the influence of intoxicating liquor . . . shall be punished by a fine of not less than one hundred nor more than one…
