This is an appeal by the plaintiff from a judgment of not guilty entered, on the verdict of a jury, for the defendant. Plaintiff’s motions for a judgment notwithstanding the verdict and for a new trial were overruled. A trial was had on plaintiff’s amended complaint which alleges substantially that the defendant Guardian Life Insurance Company owned the premises and leased them to the defendant O’Brien, with the knowledge that intoxicating liquors were sold therein; that O ’Brien sold intoxicating liquor to persons who it is alleged assaulted the plaintiff; that the sale of said liquor caused…
