This case arises out of the insolvency and liquidation of the Farmers’ State Bank of Ames, Okla. The ease was tried under an agreed statement of facts, in substance as follows: On February 13, 1934, the bank was declared insolvent by the State Bank Commissioner, who thereupon took charge of the assets of the bank for the purpose of liquidation. He caused notice to be given as prescribed by section 9175, O. S. 1931, calling on all persons who had claims against the insolvent bank to present and prove the same. All persons who filed and proved their claims received full payment thereon; but…
