Suit by the Seaboard State Bank & Trust Company against the Tyler County State Bank and J. L. Chapman, commissioner of.insurance and banking, to establish its claim in the sum of $5,000 against the Tyler County State Bank, and to have said claim classified as a noninterest bearing and unsecured claim and payable out of the depositors’ guaranty fund.
