The declaration, which was in two counts, alleged that the action was brought by the plaintiff for his own benefit, as the father and next of kin of the intestate. It is conceded that the death of the plaintiff’s intestate was due to the gross negligence of an engineer in the employ of the defendant. The defence rests on two propositions, first, that the- plaintiff’s intestate was not a passenger, but an employee; secondly, if that is not so, that the defendant is not liable by reason of the conditions on the back of the ticket.
