Now pending before the court are the petitions of Mercy First seeking review of a failed condition of a surrender of the parental rights by Ms. S. to her two children, MP and CP. For the reasons set forth below, the court holds that there has been a failure of a material condition of the surrenders and that the court has the authority to vacate the surrenders as a result. The court further holds that under the circumstances of this case, a hearing must be held for the court to determine whether vacatur of these surrenders is in the children’s best…
