Action by appellee to recover damages for assault and battery and false imprisonment. The complaint is in two paragraphs, the first being an ordinary complaint alleging assault and battery by one of appellant’s servants while appellee was a passenger on appellant’s train. The second after alleging that appellant without a warrant or legal authority unlawfully and maliciously arrested and placed appellee in jail for several hours, and that in making such arrest did forcibly and against his will eject him from the train to his damages.
