SUMMARY
This civil rights action is before the Court on remand from the Second Circuit solely on the issue of alleged violations of plaintiff’s First Amendment right to free speech. Plaintiff, Brian Sheppard (“Sheppard”), seeks a declaratory judgment, injunctive relief, and monetary damages pursuant to to 42 U.S.C. § 1983 (“Section 1988”; “§ 1983”).
