On the night of July 3, 1931, plaintiff, in company with two other young men, was driving his automobile north on Main street in Monona, Iowa. He collided with a truck parked on the easterly side of the street without headlights, taillight, illuminated number plates, warning device, or reflectors. Main street was twenty-four feet wide between curbs. The truck was used by the construction company on a local paving job, and was owned by the defendant Baker.
