There is little dispute in the facts. Plaintiff’s decedent, Joseph Olson, was killed at about 7 o’clock p. m. on December 25, 1933, by an automobile driven by the defendant, G. F. Nelson. The accident occurred on the Lincoln Highway, United States No. 30, about twelve miles west of Cedar Rapids, Iowa. A Mr. Foitle had driven his automobile off the highway into the ditch on the north side, and Joseph Olson, the decedent, who was employed by a garage in Cedar Rapids, was sent out in a service car for the purpose of towing the Foitle car back to Cedar Rapids.
