QUINN, Chief Justice.
We granted certiorari to review the decision of the court of appeals in Buckmiller v. Safeway Stores, Inc., 690 P.2d 883 (Colo.App.1984), which affirmed the trial court’s denial of a rule 60(b) motion to vacate an earlier order of dismissal for failure to prosecute. The motion to vacate the order of dismissal was filed by Jacqueline M. Buckmiller, who had previously commenced a negligence action against Safeway Stores, Inc.
