I. INTRODUCTION
Amgen, Inc. (“Amgen”) originally brought this action against F. Hoffmann-La Roche Ltd., Roche Diagnostics GMBH, & Hoffmann-La Roche, Inc. (collectively “Roche/Hoffmann”) seeking a declaratory judgment that Roche/Hoffmann currently infringes or will infringe Amgen’s patents for erythropoietin (“EPO”). Am. Compl. ¶ 26 [Doc.
