MEMORANDUM AND ORDER

YOUNG, District Judge.

Amgen brought this action seeking a declaratory judgment of infringement of several patents related to recombinant er-ythropoietin (“EPO”), which mimics a naturally occurring hormone that stimulates production of red blood cells. Amgen, Inc. v. Hoechst Marion Roussel, Inc., 339 F.Supp.2d 202, 213 (D.Mass.2004) [hereinafter “Amgen III ”].
