MEMORANDUM OPINION
SPELLMAN, District Judge.
This matter is before the Court on appeal from an Order of the United States Bankruptcy Court of the Southern District of Florida, 49 B.R. 528.
BACKGROUND
The plaintiff/appellee, Jefferson National Bank (hereinafter referred to as “Jefferson Bank”) filed an action in state court, on July 11, 1984, to foreclose a mortgage on Betty Kail’s home, seeking recovery upon a promissory note made by I.A.
