OPINION

BEVILACQUA, Chief Justice.

This is an appeal by the defendant, Bruce Leonardo, from a denial by a Superior Court justice of his motion to reduce sentence in accordance with Rule 35 of the Superior Court Rules of Criminal Procedure.

In March 1974, a Superior Court jury convicted defendant of murder in the second degree and conspiracy to commit murder. Four other individuals also had been indicted in connection with this crime. The state successfully had moved to sever Leonardo’s trial from his codefendants and then presented the case against Leonardo in a trial before a jury. After…
