This is an appeal from a judgment for the plaintiff entered by the Shiawassee county circuit court. The opinion of the trial judge set out the facts and the position of the parties succinctly and lucidly and explains his application of the law with such cogency that we will adopt it as our own, adding only comment on matters peculiar to this appeal.
