T. E. Daniel filed suit against the Beaumont, Sour Lake & Western Bailway Company, and against Frank Andrews, alleged in the petition to have been the duly appointed and acting receiver of the properties of said railway company, to recover damages, alleged to have been sustained by said Daniel, on account Of the matters and under the circumstances in the petition alleged. The basis for damages is that the plaintiff was a passenger on one of the passenger trains of defendant railway company on the 24th day of November, 1914, between Beaumont and Hardin; that the conductor on said train,…
