The hill in this cause was filed by the complainant, W. L. Warters, to recover upon an account alleged to he due him from the defendants, Morgan county and W. Y. Boswell.

The chancellor dismissed the hill as to the defendant Boswell, and snstained it as to Morgan connty, rendering a decree against Morgan connty in favor of the complainant for the sum of $265.20, with interest from August 29, 1923, amounting to $11.54, or a total of $276.74,. together with all costs of suit except the' cost incident to making the defendant Boswell a party defendant.
