ORDER
HUNT, District Judge.
This action is before the Court on the parties’ cross-motions for summary judgment. The Court heard oral argument on these motions on August 9, 2000. For the reasons stated below, the motions are GRANTED IN PART and DENIED IN PART. 1
I. BACKGROUND
This action arises out of plaintiff George M. Weaver’s 1998 candidacy for the seat on the Supreme Court of Georgia currently held by Justice Leah J. Sears. Weaver and co-plaintiffs Robert Rohm and D.
