OPINION

BOWNES, District Judge.

This is a civil rights action brought pursuant to 42 U.S.C. § 1983 alleging the deprivation of rights secured to the plaintiff by the Fourteenth Amendment to the United States Constitution and by Section 303(a)(1), (3) of the Social Security Act of 1935, as amended, 42 U.S. C. § 503(a)(1), (3) 1 and 26 U.S.C. § 3304(a) (5) (B). 2 Plaintiff seeks a declaratory judgment pursuant to 28 U.S.C. §§ 2201 and 2202 declaring NH RSA 282:3, subd.
