—Proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Kings County (Yoswein, J.), dated September 29, 1994, to review a determination of the respondents, dated March 3, 1993, which, after a hearing, found the petitioner guilty of three of four charges of misconduct filed against him and dismissed him from the department.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs.
