Proceeding pursuant to CPLR article 78 (transferred to this *709Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent State Department of Social Services which denied petitioner’s application for renewal of his certificate to operate a residence for mentally disabled adults.
