Appeal by the defendant from a judgment of the Supreme Court, Kings County, rendered July 22, 1977, convicting him of criminal sale of a controlled substance in the third degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. The undercover police officer testified that he approached defendant on the street and told him that he had $46 and that he wanted five bags of heroin.
