MEMORANDUM AND ORDER
On October 15, 2001, plaintiff Angelo J. Speziale, filed a complaint against defendants Bethlehem Area School District (“BASD”) and Thomas J. Doluisio (“Dolui-sio”), the Superintendent of the BASD. On January 4, 2002, plaintiff filed an Amended Complaint. On January 31, 2002, plaintiff filed a Second Amended Complaint. On April 24, 2002, plaintiff voluntarily dismissed Doluisio and the Second Amended Complaint.
