This was a bill brought by Byan against Sanford to redeem certain land from a sale under a power in a mortgage. On the 1st day of January, 1877, Byan made and executed his promissory note for $650, payable to John Trowbridge, at Poughkeepsie, New York, three years after date, with interest at the rate of ten per cent per annum, payable annually. On the same day Byan executed and delivered to Trowbridge, as security for the payment of said note, a mortgage upon the land in question.
