MEMORANDUM

A. RICHARD CAPUTO, District Judge.

Presently before the Court is the defendants’ motion for summary judgment on the plaintiffs remaining procedural due process claim. (Doc. 22.) Because the defendants did not deprive the plaintiff of its property interest, due process is unnecessary, and the due process claim fails. Therefore, the motion will be granted and judgment entered in the defendants’ favor.
