The plaintiff’s manufacturing plant is located in the City of Pittsburgh on the Ohio River, having a frontage thereon of approximately 1,350 feet, and along it for a considerable distance a wharf was built. Immediately above is the land of the Pressed Steel Car Company, where the defendant was engaged in constructing a concrete embankment. Wooden frames were used in the work, and, when the cement had sufficiently dried, the supporting boards were thrown upon the bank and burned.
