LEIBELL, District Judge.
This is an action to recover for the wrongful death of Peter J. Curran on October 15, 1948, as the result of an electric shock sustained in the course of his employment. At the time of his death decedent was employed by the defendant as a shift engineer and was licensed as such by the Federal Communications Commission. He was working at the defendant’s radio station at Brent-wood, Long Island, New York.
