This proceeding in error is prosecuted to review the action of the trial court wherein the defendant in error, as plaintiff, contested the title of the plaintiff in error, as defendant, to the office of county commissioner for the First eommissoners’ district of Blaine county!

The parties will be herein referred to in the order and style in which they appeared in the trial court.

Issues having been joined, the cause was tried to the court without a jury. Findings of fact and conclusions of law were made as follows:
