I. INTRODUCTION

To what degree may a court interfere with an administrative agency’s budgetary process in a construction project? That is the dilemma facing the court when deciding the issues arising in this post-award bid protest case. Plaintiff, First Enterprise, challenges the U.S. Department of Veterans Affairs (“agency” or ‘VA”) award of a contract to DJM Construction Co., Inc.
