The first and second assignments of error relate to the overruling of the demurrer to the declaration. The declaration alleges that the county of Jefferson issued its bond, and then and there acknowledged itself indebted to bearer in a sum of money payable at a day certain with interest at eight per cent per annum, and at the day payment was refused, plaintiffs being the bearer and entitled thereto.
