Error to Wayne; Rohnert, J. Assumpsit by the board of water commissioners of the city of Detroit against the board of education of the city of Detroit for water furnished. There was judgment for defendant on a verdict directed by the court, and plaintiff brings error.

'Montgomery, J.

The question in this case is whether, under the act of 1853 (Laws 1853, Act No. 90), establishing a water board, and.under the amendments to that act, the plaintiff is entitled to receive pay for water furnished to the school board. The circuit judge, while of the opinion that, as a matter of right and justice, this question should be answered in the affirmative, concluded that this court had, in effect, decided the question the other way in Board of Water Com’rs of Detroit v. Railway Co., 131 Mich. 1 (90 N. W. 657, 91 N. W. 171), and directed a ■verdict for the defendant. The…
