On October 5, 1998, the defendants in this class action tobacco litigation filed four motions for summary judgment. With these motions, defendants first seek judgment on the argument that the statute of limitations stops certain of plaintiffs’ claims [Doc. 272]. Second, the defendants ask for judgment on plaintiffs’ civil conspiracy claim and as to plaintiffs’ right to punitive damages [Doc. 277].
