OPINION
ROBERT L. CARTER, District Judge.
This is an appeal from Magistrate Raby’s ruling denying defendant’s motion to disqualify plaintiff’s counsel. After a full hearing the Magistrate denied the motion based on his conclusion that the matter in which plaintiff’s counsel advised defendant was wholly unrelated to the instant case and that the “prior representation was not of such a nature as in any way to have compromised or prejudiced the preparation of the defense in the instant action by reason of any assumed unfair tactical advantage gained by the present attorney for the plaintiff,…
