This case presents error from the county court of Custer county. Plaintiff in error, who was plaintiff below, commenced an action on June 29, 1908, in the county court of said county against the defendants in error to recover $271 alleged to be due on a promissory note. The defendants answered, admitting the execution of the note sued on, but denied liability thereon, because of a failure of consideration and fraud, and set up a counterclaim and damages amounting to $832.50.
