This action was filed upon January 4, 1913, in the district court of Cleveland county, by Ben F. Williams, as plaintiff, against the Equitable Life Assurance Society of the United States, as defendant, for the recovery of $2,000 upon a policy of life insurance on the life of Thomas J. Gentry, deceased, the plaintiff having become the owner by assignment of the rights of the beneficiary in the policy. The defendant resisted recovery upon the ground that, as contended by it, there was no liability under the policy for the reason that the beneficiary, Alverta B. Gentry, had…
