Plaintiff’s complaint is substantially as follows:
That the defendant is a municipal corporation; that on the 2d day of April, A. D. 1901, at the election held in the city of Denver, county of Arapahoe, plaintiff was elected to the office of city attorney in and for said city; that upon the 14th day of April, 1901, he qualified and entered upon the duties of the office and continued to fulfill and perform such duties for the full term of two years from said 14th day of April; that on the first day of December, 1902, the city of Denver and the county of Arapahoe by and under the provisions of a…
